Interim framework, 1947–1956
At independence, Pakistan adapted the Government of India Act 1935 as an interim constitutional framework. The Constituent Assembly had to build institutions for a geographically divided federation while debating representation, federalism, religion and the executive. The Objectives Resolution was adopted in 1949.
The 1956 Constitution
Pakistan’s first Constitution established a parliamentary federal system and declared the country an Islamic Republic. Persistent political instability and conflict over power culminated in its abrogation in 1958.
The 1962 Constitution
Ayub Khan introduced a presidential Constitution built around a strong executive and indirect electoral structures. Opposition grew during the decade, and the framework did not survive the transfer of power to Yahya Khan in 1969.
The 1973 Constitution
Following the separation of East Pakistan, elected parties negotiated a new consensus Constitution. It established a federal parliamentary system, a bicameral Parliament and a scheme of fundamental rights and Islamic provisions. It remains Pakistan’s operative constitutional foundation.
Suspension, restoration and amendment
Military interventions and major amendments repeatedly changed the balance among president, prime minister, Parliament, provinces and courts. The Eighth and Seventeenth Amendments strengthened presidential arrangements associated with military-led periods; the Thirteenth and especially the Eighteenth Amendment restored or reinforced parliamentary and provincial authority. Later amendments changed electoral, judicial and institutional provisions.
How to analyze constitutional change
- Read the amendment text, not only political summaries.
- Identify which institution gains or loses authority.
- Separate formal constitutional design from political practice.
- Track transitional clauses and effective dates.
- Check later judgments and amendments before treating an interpretation as settled.
